If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms. If you do not agree with any part of these terms, you must not use our Service.

DracoCam is provided for lawful surveillance, security, and monitoring purposes. You agree to use the Service in compliance with all applicable laws and regulations. Prohibited uses include, but are not limited to:

  • Recording in areas where there is a reasonable expectation of privacy without proper consent
  • Using the Service for any illegal surveillance or monitoring activities
  • Attempting to breach or circumvent any security or authentication measures
  • Reselling, sublicensing, or redistributing any part of the Service without our explicit permission
  • Using the Service in a way that could damage, disable, or impair our servers or networks

We reserve the right to suspend or terminate your access to the Service if we determine, in our sole discretion, that you have violated these terms.

3. Privacy & Security

Your privacy and data security are fundamental to our Service. Our commitment includes:

  • Local-First Processing: Video and audio processing occurs on your local network to minimize data transmission
  • End-to-End Encryption: All data transmitted to and from our servers is encrypted using industry-standard protocols
  • Data Minimization: We only collect and store the minimum amount of data necessary to provide the Service
  • Transparent Data Practices: We clearly document what data we collect and how we use it in our Privacy Policy

While we implement and maintain appropriate technical and organizational security measures, you are responsible for properly configuring and using the Service and maintaining the security of your equipment and credentials.

4. User Responsibilities

As a DracoCam user, you are responsible for:

  • Maintaining the confidentiality of your account credentials and not sharing them with others
  • Ensuring you have proper authorization to install and use surveillance equipment in your chosen locations
  • Properly configuring your cameras and notification settings to protect privacy
  • Complying with all applicable privacy laws and regulations in your jurisdiction
  • Obtaining necessary consent from individuals who may be recorded by your cameras
  • Properly securing your network and maintaining the equipment you use with our Service

You agree to notify us immediately of any unauthorized access to your account or any other security breach.

5. Limitations of Liability

The Service is provided on an "as is" and "as available" basis. While we strive for excellence, we cannot guarantee:

  • Uninterrupted, secure, or error-free operation of the Service
  • Detection of all security events or incidents
  • Continuous availability of cloud storage or backup services
  • Compatibility with all camera models or network configurations

To the maximum extent permitted by law, DracoCam shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or other intangibles
  • Cost of substitute services
  • Any damages arising from security incidents or service interruptions
  • Any damages related to privacy violations or data breaches not directly caused by our negligence

Our total liability for any claims under these terms shall not exceed the amount you paid for the Service during the 12 months preceding the claim.

6. Changes to Terms

We may modify these Terms of Service at any time. When we make material changes:

  • We will notify you through the Service or via email at least 30 days before the changes take effect
  • We will provide a comparison of the old and new terms upon request
  • You will have the opportunity to review and accept the new terms
  • If you do not agree to the new terms, you may cancel your subscription

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the new terms. If you do not agree with the changes, you must stop using the Service and cancel your subscription before the changes take effect.
